I was rear ended at a stop light.?

I was stopped at a stop light and this big GMC dump truck rear ended me, the guy said his foot slipped off the brake...Anyways there is damage to my rear bumper and it the clips from holding up the bumper have dislodged. I called my insurance company that night to file a claim. Today I was told that I would have to pay my $500 deductible to get my car fixed and then my insurance company would go ofter his to get the money back only if he was found at fault. Am I getting screwed here? I thought if you hit me, you pay to get it fixed, not I pay to get it fixed! They also said if I take it to my own body shop instead of one they listed they would have an agent cut me a check to pay my own body shop what their estimate of the damage is. Any thoughts on what I should do? I have State Farm and the other guy had Nationwide.

Contact the other driver's insurance company(Nationwide), and file a claim with them. The only reason to have your insurance company involved is if he does not have insurance, or his insurance refuses to pay.

He hit you when you were stopped. He is liable for the damage. Put the claim in with his insurance and they should pay for your repairs, and for a rental when your car is in the shop.
